Terms of Service

These Terms of Service ("Terms") govern your use of the Habit AI mobile application ("App") operated by Habit AI ("we", "our", or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Eligibility

You must be at least 13 years old to use the App. If you are under 18, you represent that you have your parent's or guardian's permission to use the App.

2. Account Registration

• You may create an account using an email address and password, or by signing in with Google or Apple.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• You agree to provide accurate information and keep it up to date.
• We reserve the right to suspend or terminate accounts that violate these Terms.

3. Description of the Service

Habit AI is a habit tracking application with an AI-powered coaching assistant. The App allows you to create and track habits, log completions, view progress and analytics, chat with an AI coach for personalized guidance, and optionally sync habits with Google Calendar.

4. AI Coaching Disclaimer

The AI coaching assistant is not a substitute for professional advice.

• The AI coach provides general habit-building guidance. It does not provide medical, psychological, therapeutic, or professional advice.
• AI-generated responses may occasionally be inaccurate or unhelpful and should not be relied upon as the sole basis for any decision.
• If you are experiencing mental health issues or any condition requiring professional care, please consult a qualified professional.
• We are not liable for any actions you take based on the AI coach's suggestions.

5. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose.
• Attempt to gain unauthorized access to our systems or other users' data.
• Reverse engineer, decompile, or disassemble the App.
• Use the App to harass, abuse, or harm others.
• Attempt to manipulate or abuse the AI coaching system.
• Use automated tools (bots, scrapers) to access the App.
• Exceed reasonable usage limits.

6. Your Data

You retain ownership of all data you submit to the App. By using the App, you grant us a limited license to process this data solely for the purpose of providing the service, as described in our Privacy Policy.

You may delete your data at any time through the App or by requesting account deletion.

7. Intellectual Property

• The App, including its design, code, and content (excluding your user data), is owned by Habit AI and protected by intellectual property laws.
• You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

8. Third-Party Services

The App integrates with third-party services such as Google Sign-In, Apple Sign-In, and Google Calendar. Your use of these services is governed by their respective terms and privacy policies.

9. Service Availability

• We aim to keep the App available at all times but do not guarantee uninterrupted access.
• The App requires an internet connection to function.
• We may update, modify, or discontinue features at any time.

10. Limitation of Liability

To the maximum extent permitted by law:

• The App is provided "as is" and "as available" without warranties of any kind.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
• Our total liability for any claim shall not exceed the amount you paid for the App in the 12 months preceding the claim.
• We are not liable for any loss of data due to system failures or service outages.

11. Indemnification

You agree to indemnify and hold harmless Habit AI from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

12. Termination

• You may stop using the App and delete your account at any time.
• We may suspend or terminate your access if you violate these Terms.
• Sections on Limitation of Liability, Indemnification, and Governing Law survive termination.

13. Changes to These Terms

We may update these Terms from time to time. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of the applicable jurisdiction.
